The Court of Appeals has found that the statute providing for payment of death benefits to the estate of a deceased emplyee is unconstitutional. The decision indicates that the state constitution allows workers comp benefits to be provided only to the injured employee or, in the case of death, to dependants or to the state if there are no total or partial dependants.
