Yes, it is important to note that apportionment under LC 4664 can still be used on presumptive cases and that both LC 4664 and LC 4663 can be used for apportionment on non-presumptive injuries even for public safety employees. I am hoping that how to apply the credit for prior PD awards gets resolved by the Supreme Court in less than the 18 months or more that some are predicting. It seems to me that because the conflicting decisions on this issue can substantially impact the level of PD for the injured employee, the Court should fast track the case (assuming they have anything resembling a fast track).
